Abstract

The contemplating the constitutional and legal system of democratic countries, they unite on the principle of the independence of the judiciary until it became a constitutional principle related to the protection of human rights, which is a natural effect of the existence of a judiciary that stands on an equal footing with the legislative and executive authorities. The principle of the independence of the judiciary is considered the first principle of the general principles governing the work of the judiciary. The independence of the judiciary leads to its immunity by preventing the executive authority from intruding and interfering in its affairs and its work. The importance of this study is that it will clarify the extent to which the principle of the independence of the judiciary is applied in Islamic law compared to Palestinian legislation and the guarantees of this principle. To achieve the objective of this paper, legal socio-legal research was adopted using the qualitative approach to analyse relevant Islamic law and Palestinian legislative texts. The study concluded that the administration and structure of the judiciary in Islamic law differs from Palestinian legislation in terms of the extent of application of the principle of the independence of the judiciary.

    Ahmed M A Hamad is a Ph.D. student at the School of Law, Universiti Utara Malaysia (UUM). He has attained a Master of Public Law, Al Azhar University of Gaza, Palestine, 2018, and a Bachelor of Law, Al Azhar University of Gaza, Palestine, 2014. In addition, he has been attended workshops about how to publish in high-ranking Journals at UUM, in February 2019. He has been published so many articles in high-rank journals.

  • Haslinda binti Mohd. Anuar, Universiti Utara Malaysia

    Prof. Madya Dr. Haslinda Mohd Anuar is a senior lecturer at the School of Law, College of Law, Government and International Studies (COLGIS), Universiti Utara Malaysia (UUM). She holds a degree in Bachelor of Laws (LL. B Hons) from International Islamic University, Malaysia in 1994; Master of Law (LL.M in Public Law) from University of Wales Aberystwyth, the United Kingdom in 1996; and Ph.D. in Environmental Law from Newcastle University, the United Kingdom in 2015. Her research areas are environmental law, constitutional law, and administrative law.

    Dr. Rohizan bt. Halim is a senior lecturer at the School of Law, College of Law, Government and International Studies (COLGIS), Universiti Utara Malaysia (UUM). She is graduated from the University of Malaya in the year 1997 and 2000 respectively for my LL. B and LL.M. Obtained my Ph.D. in Law from University Kebangsaan Malaysia in 2013. Currently lecturing on the subject of Family Law and Administrative law for UUM LL. B students. My interest area is Constitutional Law and my Ph.D. research area is about Freedom of Religion. Interesting research fields would be in Constitutional Law, Freedom of Religion, and Mediation.
