Hak Anak dan Kesetaraan Gender dalam Memperoleh Pendidikan

This article discusses children's right to education in the context of gender equality as a fundamental issue in equitable social development. Despite the existence of national and international legal frameworks such as the Convention on the Rights of the Child, the Sustainable Development Goals and the Child Protection Law, gender inequality in access to and quality of education remains a challenge in many regions, especially in societies that maintain patriarchal norms. This research uses a normative-juridical approach with a literature study method to analyse legal instruments that guarantee equal rights to education and identify structural and socio-cultural barriers to their implementation. The results show that the gender gap in education has a wide impact on women's social and economic welfare and participation in development. An integrative policy strategy between positive law and Islamic law is needed, as well as gender-sensitive curriculum reform and education infrastructure. The study recommends a multidimensional approach involving legal strengthening, social change and economic empowerment as strategic steps towards an inclusive and nondiscriminatory education system.
