Pemberlakuan ancaman pidana bagi pelaku poligami belum menjadi potret umum dari hukum/undang-undang yang berlaku di negara-negara Muslim, namun keberadaannya semakin dipertimbangkan dan tetap menjadi salah satu topik hangat masyarakat Muslim Dunia saat ini. Adalah menarik jika pemberlakuan ancaman pidana bagi pelaku poligami di Turki dan di Tunisia ditelaah lebih dekat, karena kedua negara ini termasuk yang paling tegas mencantumkan klausul ancaman pidana dalam hukum positif mereka. Diskusi ini melibatkan pendapat para ulama baik klasik dan kontemporer tentang poligami, kemudian dikaji dalam perspektif teori maslahat mursalah.
